§ 8.04.220. Dust and fumes.

    It is unlawful for any person to discharge into the atmosphere, from any source within the city, air or gases containing dust and fumes in excess of four-tenths grains per standard cubic foot, or at a rate exceeding five pounds of dust and fumes per hour, unless the air and gas stream is subjected to control equipment or methods that remove such dust and fumes with a particle collection efficiency equal, or greater than that shown on the graph in Exhibit A, which is set out at the end of this section.

    B.

    Use of the graph is shown in the following examples:

    1.

    If air or gases emitted to the atmosphere contain more than four-tenths grains of dust or fumes per cubic foot, or the dust and fumes are emitted at a rate in excess of five pounds per hour, the emission must be subjected to control equipment, or methods which remove dust or fume particles with collection or removal efficiencies, as specified by the curve appropriate for particles of the same specific gravity (true specific gravity referred to water at forty (40) degrees Fahrenheit) as those contained in the emitted gas stream.

    2.

    For instance, if the emitted particles have a specific gravity of three, the curve marked three indicates the collection efficiency required, e.g.:

    a.

    Particles of two hundred (200) microns or greater shall be one hundred (100) percent removed;

    b.

    Particles of one hundred fifty (150) microns shall be ninety-nine (99) percent removed;

    c.

    Particles of one hundred (100) microns shall be ninety-six (96) percent removed;

    d.

    Particles of ninety (90) microns shall be ninety-five (95) percent removed;

    e.

    Particles of eighty (80) microns shall be ninety-four (94) percent removed;

    f.

    Particles of seventy (70) microns shall be ninety-three (93) percent removed;

    g.

    Particles of sixty (60) microns shall be ninety (90) percent removed;

    h.

    Particles of fifty (50) microns shall be eighty-eight (88) percent removed;

    i.

    Particles of forty (40) microns shall be eighty-four (84) percent removed;

    j.

    Particles of thirty (30) microns shall be seventy-eight (78) percent removed;

    k.

    Particles of twenty (20) microns shall be sixty-eight (68) percent removed;

    l.

    Particles of ten (10) microns shall be forty-three (43) percent removed.

    3.

    Where particle specific gravity falls between figures shown on the curve, collection efficiencies may be interpolated.

    C.

    This section shall not apply to mining operations, or to processing at the mine site, of the material mined, provided the mining operation is located outside the boundaries of the Las Vegas valley water district.
