§ 8.04.080. Open fires—Prohibited—Exceptions.

  • A.

    It is unlawful for any person to burn any combustible refuse including garbage, vegetable matter, waste materials, tar products, rubbed products, rags, oil and oil-soaked materials, auto bodies and auto salvage, wire and insulation, and similar smoke-producing materials, in any outdoor open fire within the city, except:

    1.

    When such fire is set, or permission given in the performance of the official duty of a public officer, and such fire in the opinion of such officer is necessary;

    2.

    When such fire is set for the purposes of the prevention of a fire hazard which cannot be abated by any other means;

    3.

    When such fire is set for the instruction of public employees in the methods of fighting fires;

    4.

    When such fire is set on property, used for industrial purposes, for the purpose of instruction of employees in methods of fighting fires;

    5.

    When such fire is set in the course of any agricultural operation in the growing of crops or raising of fowl or animals.

    B.

    Nothing in this section shall be construed to prohibit or make unlawful the construction and use of barbecue pits, grills, or outdoor fireplaces, for the preparation of food for consumption by individuals; or (when properly authorized and permitted by the fire department having jurisdiction thereof) prohibit the burning of leaves or twigs on any premises.
